These Terms govern your use of the Blue Shark Studio website and our messaging and support services. By using the site or opting in to receive messages from us, you agree to these Terms. If you do not agree, please do not use the services.
Use of the site
You may use this site for lawful purposes only. You agree not to attempt to gain unauthorized access to the site or its supporting systems, interfere with its normal operation, or use it to transmit unlawful or harmful material.
Intellectual property
The content of this site — text, design, graphics, and film and creative work presented here — is owned by Blue Shark Studio or its licensors and is protected by copyright and other intellectual property laws. You may view and share it for personal, non-commercial purposes. Any other use requires our written permission.
Messaging terms (SMS)
These terms apply to the Blue Shark Studio text messaging program.
What the program is
Blue Shark Studio operates an automated assistant referred to as the Blue Shark Robot, or Ray. If you opt in through our contact form, the system sends you status alerts about itself: online and offline notifications, battery level, and hardware faults such as a camera or microphone dropping out. Nothing sent through this program is marketing or promotional.
The program is intended for people who operate or are responsible for the system, not for the general public. Messages are generated automatically; you can reach a person at any time by emailing us at the address below.
How you join
You join by giving express written consent — for example, by checking the consent box on our website opt-in form and submitting your mobile number, or by messaging us first and confirming that you would like us to reply by text. We keep a record of when and how you consented.
Consent to receive text messages is not a condition of purchasing any goods or services.
Message frequency
Message frequency varies. Alerts are triggered by events affecting the system rather than sent on a fixed schedule, so how often you hear from us depends on how often those events occur.
Cost
Message and data rates may apply. We do not charge you for the messages themselves, but your mobile carrier may charge you for messaging and data according to your plan. Check with your carrier if you are unsure of your rates.
How to stop
You can cancel at any time by replying STOP to any message from us. After you reply STOP, we will send one confirmation message and then stop sending you messages. If you want to rejoin later, simply sign up again or message us and we will resume.

Carriers and delivery
Message delivery depends on your mobile carrier’s network and is not guaranteed. Carriers are not liable for any delayed or undelivered messages. We are not responsible for any delay, failure, or misdirection in message delivery caused by your carrier, your device, or factors outside our reasonable control.
Your privacy
Your mobile number and your opt-in are handled as described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
Keeping your number current
You agree to notify us if your mobile number changes, and you confirm that the number you give us is one you are authorized to receive messages at.
Disclaimers
The site and our services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, timely, secure, or error-free.
Information provided through our messaging service is for general informational and support purposes and should not be relied upon as professional advice.
Limitation of liability
To the fullest extent permitted by law, Blue Shark Studio will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of the site or our services. Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “last updated” date above. Your continued use of the site or our messaging services after a change takes effect means you accept the revised Terms.
Governing law
These Terms are governed by the laws of the United States and of the state in which Blue Shark Studio is established, without regard to its conflict-of-laws rules.
